These terms govern your use of Floodgate, operated by In Depth Commerce FZ LLC, registered at Compass Building, FDCW0379 Co-Working, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates ("Floodgate", "we", "us"). By creating an account or using the service you agree to these terms on behalf of yourself and the organisation you represent ("you").
2. The service
Floodgate lets you generate, edit, host and publish prelander pages, run A/B tests and view analytics. Features vary by plan. We may change or improve the service, and will give reasonable notice of changes that materially reduce functionality you pay for.
3. Accounts
You must be at least 18 and use the service for business purposes. You're responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity under your account, including by team members you invite.
4. Plans, billing and cancellation
Plans are billed monthly or yearly in advance through our payment provider. Prices exclude applicable taxes. You can cancel any time; cancellation takes effect at the end of the current billing period. You can request a full refund of your first payment within 7 days of it. After that, paid fees are non-refundable except where required by law. We may change prices with at least 30 days' notice.
5. Your content and generated pages
You keep all rights to the content you provide and to the pages generated for you. You grant us a limited licence to host, process and display that content only to provide the service. Generated copy and images may be similar to output produced for others, and you're responsible for reviewing every page before publishing it.
6. Acceptable use
You may not use Floodgate to publish unlawful, deceptive or infringing content; make false health, financial or product claims; violate advertising platform policies or consumer protection law; distribute malware; or interfere with the service. You're responsible for complying with the rules of the ad platforms and stores you use. We may suspend pages or accounts that breach this section.
7. Third-party services
Integrations such as Shopify, Checkout Champ and Funnelish are provided by third parties under their own terms. We aren't responsible for their availability or for data once it leaves Floodgate.
8. Data protection
Our Privacy Policy explains how we handle account data. When we process personal data of your page visitors on your behalf, our Data Processing Agreement applies and forms part of these terms.
9. Our intellectual property
The service, software, frameworks, templates and brand remain ours. You may not copy, resell or reverse engineer the service.
10. No guaranteed results
Conversion figures shown on our website are examples. We don't guarantee any specific click-through rate, conversion rate, revenue or ad performance.
11. Liability
The service is provided "as is". To the extent permitted by law, we aren't liable for indirect or consequential loss, lost profits or lost ad spend, and our total liability in any 12-month period is limited to the fees you paid us in that period. Nothing limits liability that cannot be limited by law.
12. Suspension and termination
We may suspend or end your access for material breach or non-payment. After termination you can export your pages for 30 days, after which we may delete them.
13. Governing law
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Ras Al Khaimah. Disputes are subject to the courts of Ras Al Khaimah, United Arab Emirates.
